Terms of Service

1. Agreement and eligibility

By downloading, accessing, or using GutCheck AI (“GutCheck,” “we,” “us,” or “our”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

You must be at least 13 years old to use GutCheck. If you are using GutCheck on behalf of another person or entity, you represent that you have authority to accept these Terms on that person’s or entity’s behalf.

2. Accounts and your content

Some features require a GutCheck account. You are responsible for keeping your credentials confidential and for activity under your account. Please provide accurate information and notify us promptly if you believe your account has been accessed without authorization.

You retain ownership of the information and content you choose to submit to GutCheck, such as wellness observations, notes, and optional photos (“Your Content”). You grant us a limited right to host, process, and display Your Content only as needed to operate, protect, and improve the service as described in the Privacy Policy and these Terms.

You are responsible for ensuring that Your Content does not violate law or infringe another person’s rights. Do not upload content you do not have the right to use.

3. Wellness tracking and optional AI features

GutCheck is designed for personal wellness tracking and informational purposes. It is not a medical device, medical service, emergency service, or substitute for a qualified clinician. GutCheck does not diagnose conditions, prescribe treatment, or guarantee that a particular food, habit, or other factor caused a symptom.

GutCheck may offer optional AI-powered reflections and coaching. AI-generated content may be incomplete, inaccurate, unsuitable for your circumstances, or unavailable. You are responsible for evaluating any AI-generated content and should not rely on it for diagnosis, treatment, medication decisions, or emergency care.

4. Subscriptions and billing

GutCheck offers a core private check-in experience without a subscription and may offer optional paid Pro features. If you purchase Pro, the applicable price, billing period, renewal terms, and any eligible trial terms are presented through Apple before you confirm your purchase.

• Purchases are processed by Apple through your Apple ID. GutCheck does not receive your full payment-card number.
• Your subscription may renew automatically unless you cancel it according to Apple’s applicable subscription settings and timing requirements.
• You can manage or cancel a subscription through your Apple ID and App Store subscription settings.
• You may use the app’s restore-purchases feature to restore an eligible subscription associated with your Apple account.
• Refund requests are handled by Apple according to Apple’s policies and applicable law.
• We may change available plans or prices for future subscriptions or renewal periods to the extent permitted by Apple and applicable law. Any material change will be handled through the notice or consent process required by Apple or applicable law.

5. Acceptable use

You agree not to misuse GutCheck. For example, you may not:

• Use the service for unlawful, fraudulent, or harmful purposes.
• Attempt to access another user’s account, private data, or subscription entitlement.
• Interfere with, disrupt, reverse engineer, or circumvent the service’s security, access controls, or payment requirements except where law prohibits this restriction.
• Upload malicious code, harmful content, or content that violates another person’s rights.
• Use GutCheck to provide professional medical services, medical diagnosis, or emergency response.

6. Privacy and data controls

Our Privacy Policy explains how we handle personal information, including wellness information, optional photos, AI permissions, and privacy-minimized product analytics. It is part of these Terms.

You may manage optional AI permissions, restore a purchase, and initiate account deletion from the app’s Settings. We may retain certain information where reasonably necessary for lawful purposes, security, dispute resolution, or the normal lifecycle of secure backups, as described in the Privacy Policy.

7. Availability, changes, and termination

We work to keep GutCheck available and useful, but the service may change, be interrupted, or be unavailable from time to time. We may add, modify, suspend, or discontinue features where permitted by law. We may also suspend or terminate access if we reasonably believe you have violated these Terms, created risk for the service or others, or are required to do so by law.

You may stop using GutCheck at any time. If you have an active subscription, deleting the app or your account does not itself cancel the subscription through Apple; manage cancellation through your Apple ID and App Store subscription settings.

8. Disclaimers and limitation of liability

To the fullest extent permitted by applicable law, GutCheck is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We do not warrant that the service will be uninterrupted, error-free, secure in all circumstances, or that it will produce any particular wellness outcome.

To the fullest extent permitted by law, GutCheck and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from your use of or inability to use the service. Nothing in these Terms excludes liability that cannot legally be excluded.

9. Changes to these Terms and contact

We may update these Terms when the service, law, or our practices change. When required, we will provide notice of material changes through the service, by email, or by another legally appropriate method. Continued use after the effective date of updated Terms means you accept them, unless applicable law requires another form of consent.
